Opinion

Action to recover broker’s commissions. Appeal from judgment dismissing the complaint at the close of plaintiff’s case. Judgment of the County Court of Nassau county reversed on the law and a new trial ordered, costs to appellant to abide the event. The plaintiff made out a cause of action. Lazansky, P. J., Young, Hagarty, Carswell and Tompkins, JJ., concur.
