Opinion

The undersigned have reviewed the evidence of record in this matter and find that plaintiff did not refile this claim by September 25, 2001 as prescribed in Commissioner's Ballance's February 16, 2001 letter.

It is therefore ORDERED that plaintiff's claim be DISMISSED with prejudice.
