Judgment affirmed, with costs. All concurred, except Williams and Kruse, JJ., who dissented upon the ground that there was an equitable assignment by the deceased to the appellant creditor of $500 of the insuranee moneys held by the plaintiff as trustee and to which he makes no claim.
