Opinion

Barrett, J.

For the reasons stated in the opinion handed down herewith, in the case of Ruth Torbett v. Same Defendant, (16 N. Y. Supp. 46,) the judgment and order appealed from should be reversed, and a new trial ordered, with costs to the appellant to abide the event. All concur.
