For the reasons discussed in the consolidated case of City of Opelousas, et al v. Robert L. Waterbury, 95-1238 (La.App. 3 Cir. 5/8/96), 674 So.2d 1128, the judgment of the trial court is affirmed in part, reversed in [1135]*1135part and rendered. All costs of this consolidated appeal are assessed against appellee.
AFFIRMED IN PART; REVERSED IN PART AND RENDERED.
