ON REMAND FROM THE ALABAMA SUPREME COURT

PATTERSON, Judge.

On the authority of Washington v. State, 562 So.2d 1304 (Ala.1990), the judgment is reversed and the case is remanded to the circuit court for a new trial.

REVERSED AND REMANDED.
