Opinion
In this case the record shows that the jury returned a verdict for the defendants, and that it was thereupon “ ordered and adjudged by the court that the plaintiffs pay the costs herein.” This is no final judgment. It is a mere order upon the plaintiffs to pay costs. The petition in error w;as prematurely filed, and the action is «till pending for final judgment.
Petition dismissed.
