Opinion

Evans, J.

1. Specific performance : contracts enforceable : contract of exchange : mutual mistake in quantity of land. In June, 1914, the parties entered into an oral agreement to exchange ground. Measurements were made and deeds executed accordingly. The claim for the plaintiff is that a mutual mistake occurred in the making of the measurements, which resulted in a very substantial deficiency against him. The following plat will aid to an understanding of the case.
