Motion to dismiss the appeal herein denied. Cross motion to amend the notice of appeal denied as unnecessary inasmuch as the appeal is deemed to have been taken from the Appellate Division order dated June 4, 1979 (see CPLR 5512, subd [a]; 5520, subd [c]). Respondent Schusselberg’s papers on appeal are to be served and filed on or before February 11, 1980.
