Vasquez v. First Horizon Home Loans

117 So. 3d 1139, 2012 WL 6028051, 2012 Fla. App. LEXIS 20821
District Court of Appeal of Florida·Decided December 5, 2012·No. No. 3D11-2972·Published

Opinion

LOGUE, J.

This is an appeal from an order denying appellants’ motion for attorney’s fees. Because appellants did not plead entitlement to the contractual fees asserted, they waived any such claim. See Stockman v. Downs, 573 So.2d 835, 837 (Fla.1991). We decline appellants’ suggestion that we extend the holding of Ganz v. HZJ, Inc., 605 So.2d 871 (Fla.1992). The order on appeal is, therefore, affirmed.
