As to issue I, we reverse the judgment entered against appellant, see Schoeppl v. Okolowitz, 133 So.2d 124 (Fla. 3d DCA 1961), and remand for new trial, and affirm as to issue II.
AFFIRMED in part, REVERSED in part, and REMANDED.
