Before Haynes, Graves, and Ramirez, Circuit Judges. Per Curiam: * Ricardo Sanchez Gonzalez appeals the sentence imposed after he pleaded guilty to making a false statement or representation to an agency or department of the United States. For the first time on appeal, he challenges the condition of his supervised release providing that if the probation officer determines that he poses a risk to another person, the officer may require him to notify that person of the risk. condition improperly delegates judicial authority to the probation officer. The Government moves for summary affirmance and, alternatively, for an extension of time in which to file an appellate brief. Sanchez Gonzalez takes no position on the motion for summary affirmance but concedes that his argument is foreclosed.

The parties are correct that the issue is foreclosed by circuit precedent. See United States v. Mejia-Banegas, 32 F.4th 450, 451-53 (5th Cir. 2022). Summary affirmance is therefore appropriate. See Groendyke Transp., Inc. v. Davis, 406 F.2d 1158, 1162 (5th Cir. 1969). Accordingly, the Government’s motion for summary affirmance is GRANTED, its alternative motion for an extension of time is DENIED, and the judgment of the district court is AFFIRMED.
