UNITED STATES of America, Plaintiff Appellee,
v.
Reginald O'Briant ALLEN, a/k/a Red Defendant Appellant.

No. 93-6804.

United States Court of Appeals, Fourth Circuit.

Submitted: January 31, 1994.
Decided: May 26, 1994.

Appeal from the United States District Court for the Eastern District of North Carolina, at Raleigh. Terrence W. Boyle, District Judge. (CR-89-41-5-BO; CA-93-134-5-BO)

Reginald O'Briant Allen, Appellant Pro Se.

Barbara Dickerson Kocher, Office of the United States Attorney, Raleigh, North Carolina, for Appellee.

E.D.N.C.

AFFIRMED.

Before WILKINSON and NIEMEYER, Circuit Judges, and CHAPMAN, Senior Circuit Judge.

PER CURIAM:

Appellant appeals from the district court's order denying his 28 U.S.C. Sec. 2255 (1988) motion. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Allen, No. CR-89-41-5-BO; No. CA-93-134-5-BO (E.D.N.C. July 9, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED
