UNITED STATES of America, Plaintiff-Appellee,
v.
Mark DuPree, Defendant-Appellant.

No. 88-6013.

United States Court of Appeals, Fourth Circuit.

Submitted: Sept. 26, 1988.
Decided: Nov. 14, 1988.

Mark DuPree, appellant pro se.

Charles Dee Griffith, Jr. (Office of the United States Attorney), for appellee.

Before DONALD RUSSELL, JAMES DICKSON PHILLIPS and MURNAGHAN, Circuit Judges.

PER CURIAM:

Mark DuPree appeals from the district court's order refusing relief under 28 U.S.C. Sec. 2255. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. DuPree, C/A 88-12-NN, CR 83-21-NN (E.D.Va. March 2, 1988). Appellant's motions for appointment of counsel and for a hearing in banc are denied. We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED.
