UNITED STATES of America, Plaintiff Appellee,
v.
Lewis R. LAW, Defendant Appellant.

No. 94-6676.

United States Court of Appeals, Fourth Circuit.

Submitted Aug. 25, 1994.
Decided Oct. 13, 1994.

Appeal from the United States District Court for the Southern District of West Virginia, at Beckley. Elizabeth V. Hallanan, District Judge. (CR-91-225, CA-93-949-5).

Lewis R. Law, Appellant Pro Se.

Sanford Benjamin Bryant, Asst. U.S. Atty., Huntington, WV, for appellee.

S.D.W.Va.

AFFIRMED.

Before RUSSELL and MICHAEL, Circuit Judges, and PHILLIPS, Senior Circuit Judge.

PER CURIAM:

Appellant appeals from the district court's order denying his 28 U.S.C. Sec. 2255 (1988) motion. Our review of the record and the district court's opinion accepting the recommendation of the magistrate judge discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Law, Nos. CR-91-225; CA-93-949-5 (S.D.W. Va. May 31, 1994). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process. The motion to file a pro se formal brief is granted.
