UNITED STATES of America, Plaintiff--Appellee,
v.
Kenny FUNDERBURK, Defendant--Appellant.

No. 95-6432.

United States Court of Appeals, Fourth Circuit.

Submitted: May 18, 1995.
Decided: June 28, 1995.

Kenny Funderburk, Appellant Pro Se. Kenneth Davis Bell, OFFICE OF THE UNITED STATES ATTORNEY, Charlotte, NC, for Appellee.

Before NIEMEYER and WILLIAMS, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

Appellant appeals from the district court's order denying his 28 U.S.C. Sec. 2255 (1988) motion. We have reviewed the record and the district court's opinion, and find no reversible error. Accordingly, we affirm on the reasoning of the district court. United States v. Funderburk, Nos. CR-92-30-P; CA-95-61-3-P (W.D.N.C. Feb. 6, 1995). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process.

AFFIRMED.
