MEMORANDUM***

The Government appeals the dismissal of its indictment against Fernando Flores-Huizar arising out of its failure to comply with a discovery order. Based on the stipulation of the parties and for the reasons set forth in our opinion in United States v. Gomez-Lopez, 62 F.3d 304 (9th Cir.1995), we reverse the dismissal of the indictment because the scope of discovery ordered bears no relationship to the decision to prosecute Mr. Flores-Huizar.

REVERSED and REMANDED.
