UNITED STATES of America, Plaintiff Appellee,
v.
Donald Lamont POSTELL, Defendant Appellant.
No. 92-6982.
United States Court of Appeals, Fourth Circuit.
Argued March 30, 1993.
Decided May 6, 1994.
Appeal from the United States District Court for the Western District of North Carolina, at Charlotte. Robert D. Potter, District Judge. (CR-88-136-C-CR, CA-92-58-3-P)
Donald Lamont Postell, Appellant Pro Se.
Harry Thomas Church, Asst. U.S. Atty., Charlotte, NC. for appellee.
W.D.N.C.
AFFIRMED.
Before WIDENER, WILKINSON and WILKINS, Circuit Judges.
PER CURIAM:
Donald Lamont Postell appeals from the district court's order refusing relief under 28 U.S.C. Sec. 2255 (1988). Our review of the record and the district court's opinion accepting the recommendation of the magistrate judge discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Postell, No. CR-88-136-C-CR (W.D.N.C. Sept. 8, 1992). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisioal process.
