The point involved in this case is the same as that involved in the ease of U. S. v. Clarence P. Arzner, 53 S. Ct. 238, 77 L. Ed. -, decided by the Supreme Court of the United States on January 9, 1933; and, on the authority of that decision, the judgment of the court below is affirmed.

Affirmed.
