Tuttle/white Constructors, Inc. v. Mellon National Mortgage Co. of Ohio

363 So. 2d 187, 1978 Fla. App. LEXIS 16448
District Court of Appeal of Florida·Decided October 11, 1978·No. No. 77-1119·Published

Opinion

PER CURIAM.

The judgment is affirmed. However, the order taxing costs included the cost of copies of depositions contrary to Florida Greyhound Lines v. Jones, 60 So.2d 396 (Fla.1952); but see County of St. Lucie v. Browning, 358 So.2d 253 (Fla.4th DCA 1978). The case is remanded for the entry of a new order taxing costs which will exclude the cost of the copies.

GRIMES, C. J., and HOBSON and DAN-AHY, JJ., concur.
