[1263]*1263 On Remand from the Alabama Supreme Court

BASCHAB, Judge.

On the authority of Ex parte Tupper, 764 So.2d 1262 (Ala.1999), we reverse the judgment of the circuit court and remand this cause to the Blount County Circuit Court for proceedings consistent with the Alabama Supreme Court’s opinion.

REVERSED AND REMANDED.
