Opinion
Appeal from an order denying a motion to punish for contempt for failure to pay alimony. Order reversed, on the law and facts, with $25 costs, and matter remitted to the Special Term with a recommendation that common-law proof be taken and the justice presiding determine the facts in controversy from such proof rather than from affidavits. All concur.
