ORDER 15 Defendant. 16 17 Plaintiff, a state prisoner, proceeds pro se with a civil rights action pursuant to 42 U.S.C. § 18 1983. Plaintiff’s in forma pauperis affidavit states he had approximately $7,500 when he signed 19 the affidavit and commenced this action. This is also reflected on plaintiff’s trust fund account 20 statement. 21 In order to commence an action, plaintiff must either pay both the $350.00 filing fee and 22 the $55.00 administrative fee for a civil action, or be granted leave to proceed in forma pauperis.1 23 See 28 U.S.C. §§ 1914(a), 1915(a). The court may authorize the commencement of an action 24 “without prepayment of fees and costs or security therefor, by a person who submits an affidavit . 25 . . that [he] is unable to pay such fee or give security therefor.” 28 U.S.C. § 1915(a). Thus, plaintiff has made an inadequate showing of indigency. 3 || See Olivares v. Marshall, 59 F.3d 109, 112 (9th Cir. 1995); Alexander v. Carson Adult High Sch., 4 | 9 F.3d 1448, 1449 (9th Cir. 1993). Plaintiff will therefore be granted 30 days in which to submit 5 || the appropriate filing fee to the Clerk of the Court.
