On Remand from the Alabama Supreme Court

McMILLAN, Presiding Judge.

Pursuant to the Alabama Supreme Court’s decision in Ex parte Toumsend, 793 So.2d 835 (Ala.2000), the trial court’s judgment is due to be reversed and a judgment rendered for Townsend.

REVERSED AND JUDGMENT RENDERED.

COBB, BASCHAB, SHAW, and WISE, JJ., concur.
