SECOND UNOPPOSED MOTION TO EXTEND TIME TO FILE APPELLANT’S BRIEF ON THE MERITS

To the Honorable Court of Appeals:

This is the Second Motion to Extend the Time for Filing the Appellant’s

Brief on the Merits. The Appellant (Tommy Parker, Jr.) requests an

extension of time until Monday, July 28, 2025.

1. The judgment in this case was signed on January 14, 2025. Parker filed

a Motion for New Trial. The Notice of Appeal was filed on April 14,

2025. The Clerk’s Record was filed on May 7, 2025. The Reporter’s

Record was filed on May 15, 2025. No prior extensions of time have

been requested.

2. The Appellant’s Brief was originally due on June 16. 2025. The Court

has granted one extension of time – to July 16, 2025. This is the

Appellant’s second request. If the request is granted, the Court will

have permitted extensions totaling 42 days.

3. Appellant requests an extension of time to file his Brief on the Merits.

2 He seeks permission to file his Brief on July 28, 2025. This extension

would provide him with an additional twelve days to submit the Brief.

The request for an extension of time is unopposed.

4. There is good cause for the extension of time. During the time since

the Court granted an extension to July 16, counsel for Appellant

learned that he has a serious blockage in three cardiac arteries. Open

heart surgery is being scheduled for the very near future (likely during

the week of July 28th). While most of the brief is finished, the constant

testing, consultation, and second opinion process has taken

considerable time and energy during the time granted for the extension

(not to mention the surprise of learning that heart surgery was needed).

Counsel intends to finish the brief before surgery and has been told he

can expect to back for a limited work schedule at or near the time that

the Appellee would be filing her brief. A brief extension of time to

prepare this document will allow for the creation of a brief that is

beneficial to the court.

5. The short extension of time is unlikely to cause a substantial delay in

the ultimate disposition of this case.

3 6. Counsel has conferred with opposing Counsel, and there is no

opposition to this request.

7. Parker requests that the Court extend the time for filing the Appellant’s

Brief on the Merits to July 28, 2025.
