Tommy G. PERKINS, Plaintiff-Appellant,
v.
Federico F. PENA, Secretary, United States Department of
Transportation, Defendant-Appellee.

No. 95-1160.

United States Court of Appeals, Fourth Circuit.

Submitted: April 20, 1995.
Decided: May 19, 1995.

Tommy G. Perkins, Appellant Pro Se.

E.D.N.C.

DISMISSED.

Before WIDENER, WILKINSON, and WILKINS, Circuit Judges.

PER CURIAM:

Appellant seeks to appeal the district court's order denying relief on his 42 U.S.C. Sec. 1983 (1988) complaint. We have reviewed the record and the district court's opinion accepting the magistrate judge's recommendation, and find no reversible error. Accordingly, we deny leave to proceed in forma pauperis and dismiss the appeal on the reasoning of the district court. Perkins v. Pena, No. CA-94-124-5-MC (E.D.N.C. Jan. 6, 1995). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
