Assumpsit on a policy of insurance. The plaintiff, who was the prevailing party, sent to the Isle of France a commission to take evidence. The depositions of five witnesses were taken under the commission, and triplicate copies were sent to the plaintiff by different vessels. The expenses for executing the commission were 1431 dollars ; but the Cov.rt, in the exercise of their discretion, allowed the plaintiff to tax for them in his bill of costs, only the sum of 400 doJars,
