In view of the ample discussion of the law applicable to the facts set forth above, contained in the case of Mayor etc. v. Harvey, 114 Ga. 733 (40 S. E. 754), no elaboration' of the ruling made in the headnote is necessary. See, in the same connection, the case of Ballard County Bank’s Assignee v. U. S. Fidelity &c. Co., 150 Ky. 236 (150 S. W. 1, Ann. Cases 1914C, 1208, 1211).

Judgment affirmed.
