TO THE HONORABLE FIFTEENTH COURT OF APPEALS:
1. Pursuant to Rules 2 and 10.5(b) of the Texas Rules of Appellate Procedure,
Appellant the State of Texas ex. rel. Joshua LaFountain respectfully requests a 30-
day extension of time to file their Appellant Brief, making the Brief due on August
19, 2025. The Appellant’s Brief is presently due on July 19, 2025.
2. Additionally, Appellant requests an additional thirty (30) day extension of
time to file his Appellant Brief due to the complexity of the case, competing demands
on counsel’s time in other cases, and the need for additional research to ensure an
optimal brief.
3. Appellees have indicated that they do not oppose a thirty (30) day extension
for Appellant to file its Appellant Brief.
4. This Motion is timely filed and not brought for purposes of delay, but so that
justice may be done.
PRAYER
For the reasons set forth herein, the Appellant the State of Texas ex. rel. Joshua
LaFountain respectfully requests that the Court grant him a 30-day extension of time
to file its Appellant Brief, making the Brief due on August 19, 2025.
