Opinion

The Chief Justice

delivered the opinion of the court.

The demise laid in the declaration in this case being joint, the circuit court properly rejected the deed offered in evidence by the lessors of the plaintiff in support of their title, inasmuch as the deed proved them to be tenants in common, and not. joint tenants, and therefore did not correspond with the title alledged.

Judgment affirmed with cost.
