In this case the appeal is not regularly brought up : there is no bill of exceptions, no statement of facts, no special verdict any thing equivalent thereto. But, as' on the examination of the record, ive are of opinion the case is not such a one, in which damages ought to be given, on account of the delay, it is ordered that the appeal be dismissed with costs.
