Opinion

*36 Connor, J.

The judgment in this action is affirmed on the authority of Richmond Mortgage and Loan Corporation v. Wachovia Bank and Trust Co., et al., ante, 29. In that case it was held that section 3 of chapter 275, Public Laws of North Carolina, 1933, is valid. On the facts found by the judge presiding at the trial of this action, there is no error in the judgment.

Affirmed.
