Judgment reversed upon the facts and a new trial granted, costs to the plaintiff to abide the event, on the ground that the judgment is against the weight of the evidence. Findings of fact 4, 6, 8,10 and 11, and conclusion of law 1, are reversed. Lazansky, P. J., Young, Kapper, Scudder and Tompkins, JJ., concur.
