Sundelof v. Simco Trading Co. Inc.
29 N.E.2d 190, 302 Mass. 603, 1939 Mass. LEXIS 1162
Opinion
Exceptions overruled. The plaintiff’s requests for rulings, numbered 5 and 6, were properly denied, since they asked rulings as to the legal effect of a part only of the facts which might have been found, bearing upon the conduct of the defendant's servant. The plaintiff’s request numbered 10 was properly denied, since it could not be ruled as matter of law that the defendant’s servant was negligent.
