Opinion

It is the opinion of this Court, that the variance isa material one, and that the Judge of the Court of Common Pleas erred, in not rejecting the judgment, on account of variance, between the allegation and proof offered. The verdict in this case is therefore set aside, and a new trial ordered in said Court.
