Judgment modified by striking out the item of costs allowed under section 1512 of the Civil Practice Act,* and as so modified affirmed, with costs to the respondent. Section 1512 of the Civil Practice Act has no application to this action. All concur. Present — Sears, P. J., Crouch, Taylor, Thompson and Crosby, JJ.
