JUDGMENT

This court has considered the record on appeal in this case and holds that there

was error in part of the trial court’s judgment. We conclude that the trial court erred

as a matter of law in its declaration that Stormie Callaway was not a successor to the

easement agreement. Because we sustain Callaway’s challenge to this singular

declaration, we remand the question of fee segregation to the trial court to exercise its

discretion to decide whether the attorney’s fee award should be recalculated. We affirm the trial court’s judgment other than the remand on the question of

attorney’s fees.

It is further ordered that Stormie Callaway shall pay all costs of this appeal, for

which let execution issue.
