Judgment and order reversed, and new trial granted, with costs to appellant to abide event, on the ground that the verdict is against the weight of the evidence. All concurred, except Sewell, J., who dissented; Lyon, J., not sitting. The court disapproves of the finding that the defendant, committed an assault.
