By the Court.

The petition was filed in 1877, and, consequently, is governed as to printing by rule 5. The act -of 1878, which took effect September 1, 1878 (75 Ohio L. -804, § 5, incorporated in the Rev. Stat., § 6711), has no application, as to the matter of printing, to cases pending in this court previous to September 1, 1878.

Motion overruled.
