J., O’Malley, Glennon, Untermyer and Cohn, JJ.; O’Malley and Untermyer, JJ., dissent and vote to reverse and dismiss the petition for the reasons stated in the dissenting opinion in Gerschon v. Travelers Insurance Co. (251 App. Div. 281).
