Action brought to recover damages for an alleged breach of contract, by the terms of which the defendant agreed to construct a dam on property occupied by the plaintiff. Judgment in favor of the plaintiff, entered upon the verdict of a jury, unanimously affirmed, with costs. No opinion. Present — Lazansky, P. J., Carswell, Johnston, Adel and Taylor, JJ.
