For the reasons assigned in the companion ease of Bowden v. State, Department of Transportation and Development, 556 So.2d 1343 (La.App. 3d Cir.1990), the judgment of the trial court is affirmed. Costs [1349]*1349of this appeal are assessed to defendant-appellant.

AFFIRMED.
