Opinion

PER CURIAM.

We reverse on the authority of State v. Nelson, 320 So.2d 835 (Fla. 2d DCA 1975). The record reveals that appellee’s counsel verbally acquiesced in open court to the court’s setting of appellant’s trial date beyond the time for speedy trial.
