Opinion

The application is denied. In view of the response made by the district judge, the showing made in the instant case does not warrant the exercise of our supervisory jurisdiction.

SUMMERS, J., is of the opinion the writ should be granted. See State v. Paternostro, 224 La. 87, 68 So.2d 767 (1963).
