Opinion
We overrule the appellant's fourth and fifth assignments of error upon our determination that the common pleas court properly declined to entertain the appellant's petition for postconviction relief. The petition represented the appellant's second attempt to secure relief under R.C.
We also overrule the appellant's first and second assignments of error. The appellant was not entitled to discovery to develop his postconviction claims or to experts to aid in that discovery, when his petition was subject to dismissal under R.C.
Finally, we overrule the appellant's third assignment of error upon our determination that the common pleas court properly declined to declare the postconviction statutes unconstitutional. R.C.
We, therefore, affirm the judgment of the court below.
Further, a certified copy of this Judgment Entry shall constitute the mandate, which shall be sent to the trial court under App.R. 27. Costs shall be taxed under App.R. 24.
