Roache, J.

An information was filed against O'Conner, in the Tippecanoe Court of Common Pleas, for retailing without license.

The information, which contained two counts, was founded on the provisions of an act entitled, “An act to regulate the sale of spirituous liquors in the county of Tippecanoe," approved February 13, 1851.
