PER CURIAM

Stay lifted; motion to modify stay order denied as moot; writ granted in part. We lift the stay order previously issued so that the district court can act expeditiously on defendant's motion to proceed in fonna pauperis. We grant defendant's application in pah to remand to the court of appeal to reconsider its ruling in light of the outcome, f the proceedings on defendant's motion to proceed in forma pauperis. The application is otherwise denied. REMANDED
