Opinion
In re Johnnie Lee Hines, applying for writs of certiorari or review. Parish of Ouachita. No. 39929.
Writ granted. Relator’s conviction is set aside. Ruling of the trial court refusing to quash is reversed. Relator’s D.W.I. conviction of 1/10/79 is constitutionally deficient, State v. Jones, 404 So.2d 1192 (La.1981) and may not be used as an underlying conviction. The case is remanded for further proceedings.
