Opinion

A variance between the charge and proof of the ownership of goodsstolen is fatal.

If the indictment charge the property stolen to belong to one, and it is proved to be the property of that one and another, the defendant must be acquitted. State vs. Hearns. Sussex, Ap'l. Term, 1835.
