fl Andre Paul Becklin was accused of stalking his ex-girlfriend, Mary Alison McGee. At trial, the State presented evidence that Becklin had directed several of his friends to follow McGee and report back to him regarding her activities. Both parties argued in closing arguments about whether Becklin had used his friends to stalk McGee, but the State did not propose an instruction on accomplice liability. During deliberations, the jury asked if stalking could be accomplished through a third party and, after hearing from counsel, the trial court answered “yes.” The jury then convicted Becklin of stalking. The Court of Appeals concluded that the trial court’s answer to the jury’s question was improper because it was too late to amount to a proper instruction and it was an incorrect statement of the law. The State petitioned this court for review.
